The armorer who put a live round into the gun that Alec Baldwin was rehearsing with on the set of the film “Rust” in 2021 when it went off, killing the cinematographer, was found guilty of involuntary manslaughter on Wednesday. The conviction of the armorer, Hannah Gutierrez-Reed, marks the first time a jury has weighed in at trial on the fatal shooting of the cinematographer, Halyna Hutchins. After the verdict was read, prosecutors asked that Ms. Gutierrez-Reed be taken into custody and the judge, Mary L. Marlowe Sommer, agreed. A court officer led Ms. Gutierrez-Reed out of the courtroom, not in handcuffs. Mr. Baldwin is also facing a charge of involuntary manslaughter and is scheduled to stand trial in July.

State District Judge Mary Marlowe Sommer was stern with her warning during a virtual hearing, saying the start of the trial next week would not be delayed. The judge added that she reviewed the texts in question and that they were not material to Bowles' legal strategy. The upcoming trial is expected to revolve around the question of how live rounds ended up on the set. Authorities during their investigation recovered recovered six live rounds, including the round that killed cinematographer Halyna Hutchins and wounded director Joel Souza. Defense attorneys said during Wednesday's hearing that they have “plenty of evidence" that it was somebody else who put those live rounds on the set.

Baldwin, who is also a producer on the film, was charged with two counts of manslaughter in the death of "Rust" cinematographer Halyna Hutchins. Though Baldwin's manslaughter case has been dropped, the actor still faces other legal woes as a result of the accidental shooting. In early February, Hutchins' parents and sister filed a lawsuit against Baldwin, "Rust" producers and other crew members, accusing them of negligence and intentional infliction of emotional distress, among other charges. Halls' hearing was the first to be conducted under the supervision of special prosecutors Kari Morrissey and Jason Lewis. In her place, she appointed Morrissey and Lewis as special prosecutors.
David Halls, the "Rust" assistant director who handled the gun that killed cinematographer Halyna Hutchins in 2021, pleaded no contest Friday to a misdemeanor charge of negligent use of a deadly weapon. The New Mexico judge overseeing the "Rust" case sentenced Halls to six months of unsupervised probation, a $500 fine and 24 hours of community service. To date, "Rust" proceedings have been routinely disrupted by complications concerning the appointment of the case's previous special prosecutor. The first special prosecutor for the case, Andrea Reeb, stepped down earlier this month, after Baldwin's defense lawyers filed a motion requesting her removal. "My responsibility to the people of the First Judicial District is greater than any one case, which is why I have chosen to appoint a special prosecutor in the 'Rust' case," Carmack-Altwies said in a statement.

REUTERS/Drone BaseMarch 31 (Reuters) - A Santa Fe judge on Friday was to consider a plea deal that could bring the first conviction for the 2021 shooting death of cinematographer Halyna Hutchins during filming of the Western movie "Rust" in New Mexico. Santa Fe District Court Judge Mary Marlowe Sommer was to preside over a virtual hearing in Halls' case scheduled for noon ET on Friday. As first assistant director, Halls was responsible for set safety on "Rust." Armorer Hannah Gutierrez-Reed, who was responsible for firearms safety and training, will enter the same plea, according to her lawyer.
The New Mexico district attorney who had overseen the "Rust" movie set manslaughter case recused herself Wednesday and appointed new special prosecutors after weeks of upheaval and controversy in the case. New Mexico First Judicial District Attorney Mary Carmack-Altwies appointed New Mexico attorneys Kari Morrissey and Jason Lewis to serve as special prosecutors. "My responsibility to the people of the First Judicial District is greater than any one case, which is why I have chosen to appoint a special prosecutor in the 'Rust' case," Carmack-Altwies said in a statement. Reeb, a former district attorney, was named special prosecutor before being elected to New Mexico's legislature last fall. Gutierrez-Reed's legal team, however, called for the request to appoint a new special prosecutor to be denied.
Actor Alec Baldwin departs his home, as he will be charged with involuntary manslaughter for the fatal shooting of cinematographer Halyna Hutchins on the set of the movie "Rust", in New York, January 31, 2023. Alec Baldwin pleaded not guilty to charges of involuntary manslaughter for his role in the fatal shooting on the set of the movie "Rust," which will continuing filming under conditions set by a New Mexico judge on Thursday. Though he is allowed to work with those witnesses, Baldwin is barred from discussing with them "the accident at issue" or "the substance of his or the witnesses' potential testimony in the case." He is not allowed to interact with witnesses in any capacity that goes beyond his work on the movie. The judge's decision came on the same day Baldwin filed a waiver of his first appearance in court, which was scheduled for Friday.
